Frequently asked questions

  • A:  The Law Office of Benjamin B. Grandy PC provides 100% free no-obligation consultations. If our office agrees to take your case, we will do so on a contingency-fee basis, which means that you will only have to pay a legal fee if we obtain compensation for you.

  • A:  The length of each case depends on a variety of factors, including the medical condition of the client. However, in most counties in Oregon, after a case is filed in court it will typically go to trial or be resolved within 12 to 15 months.

  • A:  Not necessarily. The vast majority of cases settle before they go to trial. Legal experts estimate that 95% of cases, if not more, are settled before trial. However, if the insurance company or other defendant is unwilling to settle the case for a fair amount, then you need to file a lawsuit to protect your rights. In some cases, it may even be necessary to take the case to trial in front of a jury to obtain a fair result.

  • A:  If you are in a car crash, you can file a claim under your personal injury protection ("PIP") coverage to pay for your medical expenses. PIP coverage provides for no-fault payment of medical bills, lost wages, and other essential services. Oregon law requires that every private motor vehicle be covered by automobile insurance, including liability, uninsured motorist, and PIP coverage. If you are injured by an uninsured motorist, then you can make a claim for your damages under the uninsured motorist coverage of your own auto insurance policy.
